This includes transfer tax - usually 2% of the purchase price if you are going to live in the property yourself - and the notary costs for drawing up the title deed and registering it with the Land Registry. The costs for the mortgage deed and registering your mortgage are also at your expense. These costs are in addition to the purchase price and usually amount to several thousand euros. Please note: estate agent costs are not included in k.k. - the seller pays the sales agent, and if you use a purchasing agent, you pay those costs yourself.

Is a verbal agreement binding when buying a house?

No, in the Netherlands an oral agreement for the purchase of a home is not legally binding. The purchase is only final once all agreements have been recorded in writing in a deed of sale and signed by both buyer and seller. An agreement via e-mail or telephone is therefore not binding either. Until the moment of signing, both parties can still change their minds and withdraw from the deal without consequences. Only after signing the purchase contract are the agreements legally valid and both parties are obliged to adhere to them.

What is the legal cooling-off period when buying a house?

As a private buyer, you are entitled to a statutory cooling-off period of at least three days after signing the purchase agreement. This cooling-off period commences on the day after you have received a copy of the purchase agreement signed by both parties, and ends at midnight on the third day. During this period, you may cancel the purchase without giving any reason. This gives you time to think about it calmly, seek advice or reconsider. Please note: after the cooling-off period has expired, you are legally bound to the purchase, unless you can make use of resolutive conditions, such as a financing reservation.

If I offer the asking price, does the seller have to sell the property to me?

No, even if you offer the asking price, the seller is not obliged to sell the house to you. Legally, the asking price is only an invitation to make an offer, and not a binding offer. The seller retains the right to accept or reject your offer or to make a counteroffer. A binding agreement only comes into existence when the buyer and seller agree on the terms and conditions and these agreements are recorded in writing in a signed deed of sale.

When am I negotiating a home?

You are only officially in negotiations with the seller once they respond positively to your offer. This is the case when the seller makes a counteroffer or when it is explicitly stated that you are in negotiations. If the broker only reports that your offer is being passed on to the seller, this does not mean that there is any negotiation. The initiative lies with the seller; you cannot force yourself to enter into negotiations. The negotiation process only begins when there is a clear mutual response.
